Minsalud sues 21 EPS for non-compliance with so-called “technical reserves”

Technical reserves are formed as financial support that will allow EPSs to fulfill their responsibilities regarding the medical care of members.

The Ministry of Health confirmed on Sunday morning that it had filed a lawsuit against 21 EPS, accusing them of violating access to social health security and providing it in an effective and timely manner. Among the EPS stocks being sued are Sanitas, Nueva EPS, Salud Total, and Sora, among others.

Mensalud points out that these entities have not fulfilled the commitment to obtain technical reserves. “In the lawsuit filed, it is explained that according to the Supersalud report, the assessment of compliance with the indicators of minimum capital, sufficient assets and the technical reserve investment system – September 2023, calculated using information transmitted by the earnings per share (EPs) itself, was confirmed.” (…) Non-compliance with the technical precautions by the above-mentioned EPS,” the ministry says in a short message.

Technical reserves are formed as financial support that will allow EPSs to fulfill their responsibilities regarding the medical care of members. These reserves must be calculated taking into account factors such as forecast demand for health services, medical costs, fluctuations in the use of services and other financial risks.

Ana Maria Vesga, Director of Acemi (EPS Consortium for Contribution System) responded to the judicial action through technical tables to explain the inadequacy of the UPC, and requested spaces to delve deeper into the analysis of technical reserves. “The ministry is appealing to inaction and now judicial action and depriving the health system of the technical dialogue it requires,” Vesja wrote.
